What Marketfolk does, and what it doesn’t do.

This page hasn’t had formal legal review. By using Marketfolk, you agree to the terms below. They cover what the platform provides, how payments and fees work between makers and organisers, and what happens if something goes wrong.

Who you’re contracting with

Marketfolk is operated by Marketfolk Ltd, a company registered in England and Wales (company number 17405811), registered office 71-75 Shelton Street, Covent Garden, London WC2H 9JQ. These are the terms you agree to with Marketfolk Ltd when you use the service.

What Marketfolk is

Marketfolk introduces makers and market organisers to each other and provides the tools to manage applications, decisions and pitch payments. Marketfolk isn’t the market organiser, doesn’t run any market, and isn’t a party to the agreement between a maker and an organiser. That agreement, including what is provided, cancellation terms and dispute resolution, is between the maker and the organiser. This page covers what applies to everyone; see the terms specific to makers or organisers for what’s particular to your role.

Market information

Researched market listings are based on public sources and can change. Always confirm dates, eligibility, pricing and availability with the official organiser. A researched listing isn’t a Marketfolk partnership, offer or booking until the organiser has confirmed control of it through our verification process.

Payments and fees

Marketfolk is currently free to use for makers and organisers, with no Marketfolk subscription or booking fee. Makers still pay the organiser’s pitch price under the organiser’s booking terms. The Stripe payment integration is in development. Once payments are enabled, makers will pay organisers directly through Stripe. Stripe’s processing fees are the organiser’s responsibility and go to Stripe, not to Marketfolk. Marketfolk adds no platform fee.

Refunds and cancellations

Because the organiser is the merchant of record for each pitch payment, refund and cancellation decisions are the organiser’s, following whatever policy they display before checkout. Marketfolk doesn’t hold pitch money and can’t independently authorise a refund on an organiser’s behalf. See our cancellation and refund policy for how this generally works.

No professional assurance

Insurance documents show what a maker has supplied. Marketfolk checks the file signature and format but doesn’t verify a policy is genuine, current or legally sufficient for a given event; the status shown is “certificate supplied,” and it’s the organiser’s responsibility to decide whether it satisfies their requirements.

Organiser verification

Before any event, whether newly created or claimed from a researched listing, can accept applications or payments, the organiser must pass a one-time verification check. Verification reduces risk but isn’t a guarantee; use ordinary judgement, particularly for a market you have no prior relationship with.

Your content

You keep ownership of the photos, descriptions, reviews and other content you add to Marketfolk. By adding it, you give Marketfolk a licence to display, resize and reproduce it on the platform, including in evidence cards and other member-facing summaries, for as long as your account is active. If you delete your account, we’ll stop showing content that identifies you going forward, but factual, anonymised summaries already published (such as an aggregate attendance or review figure) may be retained as described in our privacy notice. We won’t use your name or images in external marketing without asking you first.

Acceptable use

Don’t use Marketfolk to provide false information, misrepresent control of a market or business, harass another member, circumvent the verification or payment process, or use the service for any unlawful purpose. Marketfolk may suspend or close an account that breaches this, or that we reasonably believe puts other members or Marketfolk at risk, and will explain why where it’s safe and lawful to do so.

The service is provided as available

Marketfolk is provided on an “as available” basis without a guarantee of uninterrupted access, and features may change or be added over time. This doesn’t affect any right that can’t lawfully be excluded.

Liability

Marketfolk provides the introduction and the tools; it isn’t responsible for the quality, safety, legality, insurance position or outcome of any market, pitch or transaction arranged between a maker and an organiser, or for the acts, omissions or content of any member, market or third party. To the maximum extent permitted by law: Marketfolk excludes all liability for indirect or consequential loss, including lost profits, lost business, lost opportunity, lost data or loss of goodwill, however it arises; Marketfolk’s total liability for the service itself, however arising and whether in contract, tort (including negligence) or otherwise, won’t exceed the greater of £100 or the total fees you’ve paid Marketfolk in the 12 months before the claim arose (the platform is currently free during the Founding Circle stage, so this floor applies rather than a zero cap); Marketfolk isn’t liable for any failure or delay caused by something outside its reasonable control, including an outage or fault at Cloudflare, Stripe, Resend or another supplier we rely on; and any claim against Marketfolk must be brought within 12 months of the event giving rise to it. You agree to indemnify Marketfolk against reasonable losses and costs arising from your breach of these terms or misuse of the service, except to the extent caused by Marketfolk’s own negligence. Nothing here limits liability that can’t lawfully be limited, including for fraud, or for death or personal injury caused by negligence, and nothing here affects your statutory rights as a consumer.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute, without prejudice to any mandatory consumer protection in your own country of residence.

Changes

We’ll update these terms from time to time, including before real payments are enabled. If you keep using Marketfolk after an update, that means you’re accepting the current version.
